The expected extradition of ex-CEO of Terraform Labs (TFL) Do Kwon from Montenegro to South Korea has been postponed. This happened at the request of the Supreme Court, which granted the request of the Minister of Justice Andrei Milovich, Vijesti writes.
The latter is also the country's chief prosecutor. The agency under his control filed a petition for the protection of legality with a proposal to postpone Kwon's extradition to South Korea.
The Supreme Court will issue a verdict on the legality of the decision of the Court of Appeal of Montenegro "within the time limits established by law."
On August 1, the latter rejected the US extradition request for Do Kwon and decided that he would be sent to South Korea. With his verdict, he confirmed the decision of the Podgorica High Court, adopted at the end of June.
In November 2023, the latter approved the extradition of the former head of TFL, giving Justice Minister Andrei Milovich the opportunity to choose a country. The court of appeal overturned this decision, recognizing it as contrary to the law.
In February 2024, the High Court decided to extradite the entrepreneur at the request of the United States. The ruling was also overturned after the petition. Korean citizen Kwon sought extradition to his homeland.
Montenegrin lawyer for Kwon Goran Radic said the constant delays and seven court decisions in the Kwon case represent a "disgrace."
The specialist also stated that Milovich "illegally promised" to extradite Kwon to the United States, and not to South Korea, which was the first to send an extradition request.
On March 23, 2023, the Montenegrin police arrested Kwon and former TFL finance director Han Chan Jung while trying to fly from Podgorica Airport to Dubai using false passports.
On April 5, a jury in the Southern District Court of New York found TFL and Do Kwon guilty of defrauding investors and securities fraud. The trial took nine days and was held in absentia.
In South Korea, numerous charges have been brought against Kwon, including violations of capital markets legislation.
Earlier it became known that he was released from prison in Montenegro after completing his sentence for trying to cross the border with forged documents.
Recall that Han Chang Joon was extradited to Korea in early February.
